Two people of equal drunkness can do whatever they want because there's no power imbalance*.

But someone who's a single drink in shouldn't have sex with someone who's absolutely hammered, and someone who's absolutely hammered shouldn't force themselves on someone who's blackout drunk (because that's literally rape)

Edit:

*Obviously, all other rules that would apply to non-drunk people also apply. I'm not saying they can like, murder each other or anything.
